Bans on single-use products continue to be a hot topic across the United States. Since June of this year, proposed laws that restrict or ban single-use products have been moving through the legislatures in three states. Key developments include:
- Illinois. Legislation under consideration in the state includes SB2211 and HB4448, which ban single-use paper and plastic bags. A newly signed law, SB2960, which prohibits hotels from providing single-use plastic products for personal care products, went into effect in August.
- Massachusetts. The state legislature is considering two bills focused on single-use products. S570 would restrict single-use plastics and certain products, while S2830 would phase out single-use plastic packaging and ban PFAS in some items.
- New Hampshire. HB1207, which limits single-use disposable plastic foodware accessories, is currently working its way through the legislature.
- California. The governor recently signed SB1053 into law. The law prohibits carryout single-use plastic bags and sets standards for recycled paper bags.
While state legislatures continue to debate single-use products, local governments in various U.S. regions have recently implemented bans. These include:
- Santa Fe County, New Mexico. An ordinance prohibiting single-use plastic and EPS products in retail stores and restaurants in unincorporated areas went into effect on Sept. 23.
- Upper Merion, Pennsylvania. The township recently rolled out the third phase of its single-use plastic ban, which prohibits restaurants from handing out plastic utensils. The township joins about 30 other locations in Pennsylvania that have bans on single-use plastics.
- Puerto Rico. The territory began enforcing its ban on single-use plastics on July 1.
In contrast, a court in Athens, Ohio, recently ruled against a law in the city that prohibited single-use plastic bags in retail locations, with the court saying the law conflicted with state law that permits plastic bags.
